Billing / payments

After submitting your serve for processing, you can pay online using any major credit card or bank account or send us a check. After your payment has processed, our system will allow us to complete your serve. If you wish to pay by check we recommend using an expediated delivery method. If you have difficulty receiving email you can mail a check for the total listed on our site.

Our System will only allow us to access your request AFTER it has received payment for PRE-PAY accounts.

If you do not agree to this DO NOT USE OUR SERVICE. We will not accept scanned checks as proof of payment. We will not accept faxed checks as proof of payment. We apologize for this inconvenience, however this policy is due to the large number of past due / unpaid accounts.

However, customers that have had multiple requests with us (2 or more completed) may request a POST-PAY account by emailing us. If your account is POST-PAY it will be indicated at the top of the client portal in green.

 We apologize for this inconvenience however someone(s) ruined it for everyone.


Terms of Service

Please read the Terms of Service and Conditions before you send us your documents for processing. We reserve the right to update our Terms of Service and Conditions at any time. Please read these Terms & Conditions (“Terms”) carefully before using this Website (“Site”). This Site and services herein is provided by SWVA Process Services subject to your compliance with these Terms, as well as any other agreement between SWVA Process Services and you, and may be used for informational purposes only. By using this Site or downloading materials from this Site, you agree to abide by the Terms set forth below and herein.

If you do not agree to abide by these Terms, do not use the Site or enter any service requests.

 


Payment(s)

PRE-PAY accounts: Users with an account in a PRE-PAY status, payment is due BEFORE we will perform services. We will not have access to the documents uploaded until  our system processes payment. You may pay the full amount online, utilizing multiple payment options instantly (this payment service is provided at no cost). If you wish to pay by check, please see the portal for directions. If you wish to pay by check, we recommend using an expedited delivery method. If a serve request remains unpaid for 30 days our system will automatically cancel the serve and disable online payment. If we receive a check for a cancelled serve we will destroy (shred) the check.

POST-PAY accounts: Balances unpaid incur 5% interest monthly on the balance until paid. If a open request remains unpaid for 30 or more days, Please note, if we do not receive payment within 30 days of the serve request your ability to submit new serves may be impacted automatically. If you submit multiple serve requests in a single request, we will cancel your serve and revert your account to PRE-PAY.

Original Affidavit 

We will mail the original Affidavit of Service to the address given at registration unless required otherwise. All affidavits are sent via USPS standard rate First-Class mail unless requested otherwise. We will include all ORIGINAL documentation/paperwork created in the process of completing your request unless otherwise requested, anything not sent will be destroyed otherwise; i.e. field sheets, pictures, etc. We ARE NOT responsible for the permanent storage of documents after the completion of services. Please allow up to 10 business days for your affidavit of service to arrive USPS, tracking numbers are only used when requested at additional cost.

We will not accept requests via EMAIL!

If you email a request to us rather than use our online portal it will be deleted automatically.

Service of Process

We may engage in LIMITED private investigative services to effectuate service, however this is at our discretion. If you wish for us to wait outside someone’s house, business or other place this will need to be addressed separately. All requests will receive a single affidavit, if their are multiple recipient’s you must enter a serve for each recipient. Single requests containing multiple recipient’s will be cancelled and may forfeit any funds paid.

Limited License
Subject to the Terms, SWVA Process Services grants you a non-exclusive, non-transferable, limited right to access, use and display this Site and the materials thereon. You agree not to interrupt or attempt to interrupt the operation of the Site in any way. SWVA Process Services authorizes you to view and download the information (“Materials”) made available for download at this Site only for your personal, non commercial use. This authorization is not a transfer of title in the Materialsline-height: 1.6; and copies of the Materials are subject to the following restrictions: 1) you must retain, on all copies of the Materials downloaded, all copyright and other proprietary notices contained in the Materials; 2) you may not modify the Materials in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose; and, 3) you must not transfer the Materials to any other person. You agree to abide by all additional restrictions displayed on the Site as it may be updated from time to time. This Site, including all Materials, is copyrighted and protected by worldwide copyright laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of this Site and to prevent any unauthorized copying of the Materials. Except as expressly provided herein, SWVA SWVA Process Services  does not grant any express or implied right to you under any patents, trademarks, copyrights or trade secret information.

Restrictions on Use
Your use of the Site is subject to all applicable laws, rules, and regulations, and you are solely responsible for the contents of your communications through the Site. By using any communications service or other interactive service that may be  available to you on or through this Site, you agree that you will not upload or otherwise submit or facilitate submission of any content, including text, communications, software, images, sounds, data, or other information, that:

1. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortuous, contains explicit or graphic descriptions or accounts of sexual acts (including, but not limited to, sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies;

2. Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.

3. Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party.

4. Constitutes unauthorized or unsolicited advertising, junk or bulk e-mail (also known as “spamming”), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.

5. Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party; or

6. Impersonates any person or entity, including any of our employees or representatives. Not all areas of the Site may be available to you or other authorized users of the Site. You shall not interfere with anyone else’s use and enjoyment of the Site or other similar services. Users who violate systems or network security may incur criminal or civil liability. You agree that we may, at any time and at our sole discretion, terminate your access to the Site without prior notice to you for violating any of the above provisions. In addition, you acknowledge that we will cooperate fully with investigations of violations of systems or network security at other Sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.

7. We are not responsible for the legality of the documents that we serve. The client agrees to hold SWVA Process Services harmless for poorly prepared documents that we may serve to the Servee. The client is solely responsible for the language, verbiage and validity of all documents submitted. If you are unsure about your documents we highly recommend having an attorney review your documents prior to submittal.

8. We will not attempt service on any parties on Sunday’s. We are based in SW Virginia and are unable to execute serves on Sunday as it is against Virginia code to do so, and any service performed on a Sunday would not be correctly served on the party and, most likely not be accepted by the courts. However, you can submit serves at anytime on our website.

9. Invoices left unpaid for 90 days, If an invoice is left unpaid for over 90 days, we reserve the right to terminate the request for service of process, destroy all related hardcopy items for said service and send the invoice to collections. No affidavit of service will be provided for serves un-paid after 90 days.

Personal Appearances
You agree to be billed, In the event that the server is required to provide testimony in court or other court related proceedings , at a rate of $100.00/hr, $0.75/mile & other travel expenses (from zip code 24354) for the server to appear.

Affidavit Availability and Transmittance

After your payment has processed, our system will send you the completed affidavit of service via email and we will send it through USPS. We will mail the original “Affidavit of Service” to the address given to us by you during registration, at the time payment is received. If you wish for us to send it to a different address/location you MUST let us know prior to payment, or have placed that information in the special comments section of your serve request. We will include all ORIGINAL documentation/paperwork/notes created in the process of completing your request unless otherwise requested, anything not sent will be destroyed otherwise.

As a convenience to you, SWVA Process Services may provide, on this Site, links to Web sites operated by other entities. If you use these links, you will leave this Site. If you decide to visit any linked site, you do so at your own risk, and it is your responsibility to take all protective measures to guard against viruses or other destructive elements. SWVA Process Services takes no responsibility for, and makes no warranty or representation regarding, and does not endorse, any linked Web sites or the information appearing thereon or any of the products or services described thereon. Changes

Termination of Use
You agree that SWVA Process Services may, in its sole discretion, terminate or suspend your access to all or part of the Site with or without notice and for any reason, including, without limitation, breach of these terms. Any suspected fraudulent, abusive, or illegal activity may be grounds for terminating your access and may be referred to appropriate law enforcement authorities. You agree not to make any online negative statements to include online reviews, without first attempting to resolve the matter in an arbitration platform. Upon termination or suspension, regardless of the reasons therefore, your right to use the Site and Materials immediately ceases, and you acknowledge and agree that SWVA Process Services may immediately delete all related information and files and/or bar any further access to such files or this Site.
